Plarium allowing underage gambling!!!

Your own terms of use

"Age restriction

YOU MUST BE AT LEAST 13 YEARS OF AGE TO USE THE SERVICE. IF YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER, YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THE TERMS. IF YOU ARE BETWEEN THE AGES OF THIRTEEN (13) AND EIGHTEEN (18), YOU REPRESENT THAT YOUR LEGAL GUARDIAN HAS REVIEWED AND AGREED TO THESE TERMS. If you do not agree with all of these Terms, or you are not at least thirteen (13) years of age, or you are between the ages of thirteen (13) and eighteen (18) and your legal guardian does not agree with all of these Terms, please do not access and/or use the Site or Service."

So children aged under 18 that started playing before this change and their legal guardian reviewed and agreed with the terms can now gamble.

Why is this not legal?

1. You have not informed anyone that you are introducing a gambling element in the game before the change.

BTW. If someone reports you to the EU Commission they will block access to your game in the entire EU

Plarium's lottery system does NOT count as gambling in most countries, because the rewards have no redeemable cash value. (This is pretty much the same reason it's not illegal in most places for children to play poker for candy).

you can scream "legal" til you are blue in the face, it doesnt change the fact that this is illegal.

sapphires are paid for in real money, not candy.

The issue isn't the reward have no real cash value, the issue is the ticket itself does. Because if Plarium had used some currency that can't be bought fot cash, like moon coins... It wouldn't been a issue, but if a kid go take their dads credit card and spend on 100 tickets.... to the raffle, see the problem here?

The tickets carry a real world cash value. That is the biggest issue.

sapphires are paid for in real money, not candy.

They're paid for in real money, but you can't trade them back in for real money. Therefore they have no cash value. Legally, the fact that you paid cash to get them is irrelevant.

Bio i'm sorry but i can tell you from experience that in EU this is treated as gambling.

The only way you can do it is by getting a license. I do not think they did that cause effectively they allow a 13 years old child to use this.

USA laws do not apply all over the world..... it is quite possible that it is not leagal in other countries too.

Dude here in Norway you can't even organize a bake lottery and raffle out cakes to the income of your kids soccer team :p

If Plarium exclude the ability to get tickets for rl cash.... and we could buy tickets for items aquired ingame that is not tied to any purchase for rl cash, all legal.... at least over here. but I guess it wouldnt been as attractive for Plarium to do these things if we used moon coins and amulets and stuff to buy tickets.

I think in my country if a gambling is using a token and the token is purchased by money then it's illegal. Though I'm not sure if the token can't be converted to real money again whether it's illegal or not.

As long as I don't get caught I guess >_>

Though I wonder if it's an added feature and I don't do it, can I still be prosecuted.... hm....maybe.

If gambling is illegal and you do not participate you cannot be prosecuted for gambling.

i only remember the consequences in all UE

1 financial sanctions

2 imprisonment of 6 months to 3 years

3 dimming and banned of all your service in UE

and add any aggravating for gambling addiction and minors age

ps. the EU line is very strict for money laundering, pay attention the line is shaky

If gambling is illegal and you do not participate you cannot be prosecuted for gambling.

raffling is illegal in the US as well. unless you are a 501(c)3

Because if Plarium had used some currency that can't be bought fot cash, like moon coins...
